| The Aerografia.com.es Affiliate Terms |
By filling out the signup form of our Affiliate Program, recognizing that you have read and understood the Terms and Conditions below for the Affiliate Program of Aerografia.com.es Belles Arts Ferran, S.L. and agree with them. And declares that you have the legal age required to commit this act.
1. Joining the Program
By filling out the signup form of our Affiliate Program, you will automatically become AFFILIATE and are governed by the terms reflected in this agreement. Your participation in the program is solely for this purpose: to legally advertise our website to receive a commission on products purchased by your referral individuals. The acceptance of the terms contained in this document Terms and Conditions of the Affiliate Program, gives the accession document binding CONTRACT OF AFFILIATED.
2. Payment of Commissions Conditions
I. You may request the payment of commissions, once a month from the 1st to 10th day, provided that the aggregate amount reaches a minimum of 50,00 €, must request such payment in the following email: info@aerografia.cat. In no case was made payments below this amount, the amounts below must be kept in the account and will join those of the month or months, until the amount of € 50.00. Is not made any payments, which has not been requested by email to: info@aerografia.cat. Payments from commissions requirements and are correct, will be paid by means determined by the AFFILIATE when joining our program, before the last day of the month in which it was requested. In the case of sending payments by check, if they had not been received before the tenth day of the following month their request, to be claimed: info@aerografia.cat.
II. The commissions for the sales referenced by the partner, will be retained for a period of forty-five days from the date of dispatch of the order, (the shipments are usually made within a period of less than seven working days from the date of the order ). This provides us with the margin of time necessary to offset the revenue, make changes, if any, and accept any cancellations and returns.
III. If the AFFILIATE wants it, rather than send the payment of commissions, may seek to change it by buying's tickets for our online store.
3. Causes for the Rescission of the AFFILIATE Contract
The adhesion to the Affiliate Program, (AFFILIATE CONTRACT), will be suspended or terminated in the following cases:
I. Unfit ads, (false claims, misleading hyperlinks, etc.)
II. Spamming, (sending mass emails, bulk mailing of newsletters, mass announcements in newsgroups, etc.)
III. Display of the advertisements or promotions on websites with illegal content.
IV. Violation of intellectual property rights.
V. At request of the affiliate.
In the cases I through IV, the member will lose any right on any amount and in the case V, is only entitled to receive the payment, if the balance reaches 50.00 € and request it in the email: info@aerografia.cat. Case of not achieving the aforementioned balance will lose any right on it.
4. AFFILIATE Links
You can use both types of links, graphics and text, both in your web and in your emails. You may also insert them in classified ads, magazines, newspapers, etc. You can use the links image or text that we have provided or if you prefer, you can create your own, which can be used once we adopt it, for it you must to send us to our email: info@aerografia.cat.
5. AFFILIATE Tracking
Each time anybody from the network, click on any of our links inserted by you, will be set a "cookie" in his browser which stores your AFFILIATE username. Likewise, in our database, the visitor's IP is related to your AFFILIATE username. If in the future, this customer makes a purchase, the script will try to find a cookie or match the IP with your AFFILIATE username, to provide the commission. Though much time has passed, if a visitor referred from your site, make a purchase, will receive the commission, provided the script finds the cookie and / or customer continue using the same IP, which was recorded in the database.
6. Terms of Agreement (CONTRACTS OF AFFILIATE)
The validity of these Terms and Conditions of Subscription Affiliate Program Aerografia.com.es owned Belles Arts Ferran, S.L. , will start at Join the Affiliate Program and completed when suspended or closed AFFILIATE account. Aerografia.com.es owned Belles Arts Ferran, S.L., reserves the right to modify these conditions without notice and in the event that any of these changes is unacceptable to you, your only option will be to terminate the AFFILIATE contract. Remaining in the Affiliate Program, is the tacit acceptance of any changes.
7. Duties and Responsibilities
Aerografia.com.es property of Belles Arts Ferran, S.L., is not liable for damages indirect or incidental, (loss of profits, commissions) due to failure in tracing the AFFILIATE, lost files from the database and result of any attempt to harm to our Affiliate Program, or our website. We do not offer any warranty implied, with respect to the Affiliate Program and / or products sold from this website. We do not guarantee that the functioning of the AFFILIATE program and our website will be free of errors and we are not liable for any interruption or system failure.
The AFFILIATE itself, agrees and accepts that must comply with all applicable local, provincial and national. You also agree that under no circumstances use SPAM techniques, to promote the links on this Affiliate Program.
The AFFILIATE indemnify and hold harmless Aerografia.com.es property of Belles Arts Ferran, S.L., by any legal action, damages or liabilities incurred in, arising from the day-to-day operations of the AFFILIATE. Under no circumstances Aerografia.com.es property of Belles Arts Ferran, S.L., will be responsible for wrongs, contracts or damages indirect, incidental, special, and so on., (Including but not limited to damages for any loss of revenue, of profits, business interruption or the loss of business data, loss of goodwill, for obstruction of work, for failures of hardware or software or any other pecuniary loss) arising out of or related to any of the provisions of this Agreement or the program. Without limiting the foregoing Aerografia.com.es property of Belles Arts Ferran, S.L., adding that its liability with respect to this Agreement shall not exceed the total of commissions or payments to AFFILIATED under this agreement.
Aerografia.com.es property of Belles Arts Ferran, S.L., is the owner of all rights, title and interest in and to any information created or collected during the operation of the website Aerografia.com.es property of Belles Arts Ferran, S.L., and reserves the right to amend or terminate this agreement anytime, with or without notice to AFFILIATE.
This Agreement, (CONTRACT), is governed by the laws of the Kingdom of Spain. In case of any legal dispute between the parties, both accept the jurisdiction of the courts in Barcelona (Spain) or the estates Official Barcelona (Spain), for any litigation, arbitration or mediation. Both parties accept the City of Barcelona (Spain) and its courts or estates, as the only place for any legal action or dispute.
